Trademark Registration
What is Trademark Registration?
Trademark registration in India is the legal process of protecting your brand name, logo, or slogan under the Trade Marks Act, 1999. It grants exclusive rights to the owner, preventing unauthorised use of the mark, and is one of the few forms of protection that can last indefinitely with renewal.
Trademark registration is the official process of legally securing a unique mark — including a brand name, logo, word, symbol, or combination — under the jurisdiction of the Intellectual Property India (IP India) office. Once registered, the owner holds exclusive rights to use the mark in commerce and can take legal action against infringers.
A registered trademark is denoted by the ® symbol, while an unregistered mark uses the ™ symbol. The registration is governed by the Trade Marks Act, 1999 and the Trade Marks Rules, 2017. A registered trademark is valid for 10 years and can be renewed indefinitely. A trademark application can cover words, logos, shapes, colours, and sounds, and is classified under 45 trademark classes.
Who Can Apply for Trademark Registration in India?
Trademarks can be applied for by individuals, sole proprietors, partnership firms, LLPs, and private or public limited companies, as well as NGOs, trusts, and societies.
If the applicant is a company or LLP, the mark should generally be registered in the entity’s name rather than the founder’s personally — though many early-stage founders register in their own name and license it to the company as it grows. Foreign applicants can also file in India, typically through a local trademark attorney.
Why is Trademark Registration Important for Your Business?
Legal ownership and enforcement
A registered mark lets you take infringement action in court — an unregistered mark offers far weaker legal standing.
Builds a real business asset
A recognised brand name or logo is an intangible asset that adds measurable value if you ever sell, license, or raise funding.
Licensing and royalty income
Registered trademarks can be licensed to franchisees or partners in exchange for ongoing royalty payments.
Nationwide protection
Registration grants exclusive rights across India within your class, not just in the state where you operate.
What Documents Are Required for Trademark Registration in India?
Before initiating the trademark registration process, ensure you have the following documents ready.
| Applicant Type | Documents Required |
|---|---|
| Individual / sole proprietor | PAN card, Aadhaar card, address proof, logo file if registering a device mark |
| Partnership / company | Certificate of incorporation, PAN card of the entity, board resolution or authorisation letter |
| All applicants | Signed Form-48 (Power of Attorney), user affidavit if claiming prior use of the mark |
How Trademark Registration works
Step 1: Trademark Search
A search of the existing trademark database checks whether an identical or deceptively similar mark is already registered or applied for. (1 working day)
Step 2: Class Selection & Filing
The correct class (of 45 total) is identified based on your goods/services, and Form TM-A is filed with the Trademark Registry. (1-2 working days)
Step 3: Examination
A Trademark Officer examines the application for distinctiveness and conflicts, and can raise objections that require a written response. (3-6 months)
Step 4: Journal Publication
If cleared, the mark is published in the Trademark Journal for 4 months, during which anyone can file an opposition. (4 months)
Step 5: Registration Certificate
If no opposition is filed, the Registrar issues the Certificate of Registration and the ® symbol becomes usable. (2-3 months)
